Terms and Conditions
Terms and Conditions
Effective Date: 15. October 2023
Welcome to Swiss Helicopter Wedding (“we,” “our,” or “us”). By using our website and services, you agree to comply with these Terms and Conditions. Please read this document carefully.
1. Relationship Swiss Helicopter Wedding – Client(s)
1.1 The Client contracts Swiss Helicopter Wedding to provide the agreed event planning or other experiences & services for the agreed fees. The contractual obligations commence after receiving the deposit fee, continuing until the day of the event, or the last experience or service Swiss Helicopter Wedding is contracted to coordinate upon its completion.
1.2 The Client, in the event of multiple clients in the same inquiry (e.g., a wedding couple), is considered as a single unit in the communication process. This means that actions, requests, or information provided by one party of the client(s) are assumed to be internally agreed upon. Swiss Helicopter Wedding is not liable for inconveniences resulting from actions that were not previously discussed and agreed upon by the client(s).
1.3 Swiss Helicopter Wedding can act as an intermediary and make payments for and in the name of the Client(s) to suppliers or service providers. Contracts may be established directly between the supplier/service providers and the Client(s). In such cases, Swiss Helicopter Wedding will not be liable to the Client(s) for the obligations of the supplier/service providers, nor to the supplier/service providers for obligations assumed by the Client(s).
2. Performance of Services 2.1. Swiss Helicopter Wedding is committed to providing the agreed services while considering the best interests of the Clients. We undertake to exercise reasonable care and skill when providing all services as specified in this Agreement. Our responsibilities encompass, but are not restricted to, comprehensive consultation with the Clients, meticulous selection, and supervision of vendors and subcontractors, as well as the execution of any services provided by Swiss Helicopter Wedding on any date agreed upon.
s.2.2. There is no employer-employee relationship between Swiss Helicopter Wedding and the Clients. This relationship is a professional, collaborative one where mutual respect, courtesy, and consideration are expected. Swiss Helicopter Wedding operates as an independent contractor.
2.3. When necessary, Swiss Helicopter Wedding may provide assistants to fulfill the Agreement. These assistants will adhere to all the terms of the Agreement between Swiss Helicopter Wedding and the Clients. The decision to use assistants is at the sole discretion of Swiss Helicopter Wedding, and assistant fees are the responsibility of the Clients.
2.4. Swiss Helicopter Wedding may consider assigning some or all of the obligations arising from an Agreement to trustworthy and equally experienced industry partners. However, any such decision will be communicated to the Clients for their consideration and approval before being confirmed definitively. Clients are not entitled to raise claims directly with third parties.”
2.5. Swiss Helicopter Wedding strives to provide basic office support 24/7 and aims to be available whenever necessary for the client. However, please note that Swiss Helicopter Wedding works with multiple clients at the same time, and the availability of our services may depend on the individual agreement with each customer. For clients who have booked minimum packages, our 24/7 support may not apply. Additionally, rush projects of 72 hours or less and projects requiring weekend or holiday work may be subject to a 25% surcharge and/or other rush fees. If these fees apply, the client will be informed thereof before any definitive costs are added therefore. Swiss Helicopter Wedding reserves the right to refuse any project or service request.
2.6. Swiss Helicopter Wedding requires 24 hours’ notice to cancel scheduled face-to-face appointments and 1 hour to cancel scheduled calls. The Wedding Planner will attempt to accommodate a moved appointment with less notice when possible. However, no-shows and last-minute cancellations will be billed at the full hourly rate for the scheduled time, if applicable.
2.7. New work requested by the Clients and performed by Swiss Helicopter Wedding after a proposal/estimate has been approved will be considered a Change Request and will be billed accordingly. Significant changes that alter the original specifications will be subject to a revised additional fee agreed upon by both parties.
2.8. Swiss Helicopter Wedding is authorized to deviate from the agreed services and exercise judgment when making decisions regarding changes, weather conditions, tardiness, non-performance, and other factors. Any changes will be documented and communicated in writing to the Clients. The Clients reserve the right to disagree with any deviations, especially when they lead to additional charges or a reduction in service quality.
3. Vendor Management 3.1. Based on preliminary discussions, Swiss Helicopter Wedding will gather offers from suitable vendors within the wedding budget for the defined fees, as per the wishes of the Clients.
3.2. Vendor selections proposed by Swiss Helicopter Wedding are ultimately made by the Clients unless otherwise agreed. Contracts can be established between Swiss Helicopter Wedding and the chosen vendors (for lower-cost services) or directly between the Clients and the chosen vendors (for higher-cost services, e.g., flights, accommodation, receptions). It is the responsibility of the Clients to pay all vendors and venues in a timely manner. Generally, Swiss Helicopter Wedding will choose service providers from their established network of partners, before considering any other third-party service providers.
3.3. Swiss Helicopter Wedding will exercise reasonable care and skill in locating and recommending vendors for the Clients. However, we are not responsible for the conduct or performance of any vendor which has not been chosen by Swiss Helicopter Wedding.
3.4. Swiss Helicopter Wedding does not recommend hiring vendors outside the list of Swiss Helicopter Wedding’s approved vendors.
3.5. If the Clients decide to book vendors themselves or choose vendors outside our recommendations, they must provide copies of vendor contracts for all vendors they have contracted directly. Any fees or costs for such payments are the sole responsibility of the Clients. Swiss Helicopter Wedding shall not be liable for any contracts, conduct, or performance of vendors chosen by the Clients independently.”
4. Payments 4.1. The Clients are committed to making payments to Swiss Helicopter Wedding as specified in the pertinent communications. Payments may include deposit fees, service fees, vendor costs, and any other applicable charges.
4.2. Payment schedules will be discussed and agreed upon between Swiss Helicopter Wedding and the Clients. Failure to make payments as scheduled may result in delays or suspension of services.
4.3. Swiss Helicopter Wedding accepts payment via acceptable methods, which may include bank transfers, credit cards or other methods as agreed upon in writing.
4.4. Any fees related to payments, such as bank charges or transaction fees, are the responsibility of the Clients.
5. Cancellation and Refund Policies 5.1. In the event of cancellation by either party (Clients or Swiss Helicopter Wedding), the following policies apply: 5.1.1. If the Clients cancel the event planning or services, they are subject to the terms and conditions outlined in the Agreement. Cancellation from the Clients must be communicated 6 months or more in advance to allow for potential refunds. Costs are confirmed for the Client once a service has been agreed upon by both parties. When an agreement is reached for a specific service, Swiss Helicopter Wedding immediately contracts relevant third parties or, if possible, organizes these services in advance for the Client’s experience.
5.1.2. If Swiss Helicopter Wedding cancels the Agreement, the Clients will be subject to the terms outlined in the Agreement and any specific refund terms agreed upon in writing.
5.1.3. Swiss Helicopter Wedding may propose to reschedule the event to a different date if it is determined that such a change would enhance the service provided to the Clients. However, this rescheduling can only occur with the prior consent of the Clients. The Clients are not allowed to make changes to the dates of any relevant collaborations unless specifically agreed upon in advance with Swiss Helicopter Wedding.
5.1.4. Refund policies may vary depending on the timing of the cancellation and the services provided. Specific refund terms will be discussed and agreed upon in writing. It is important to note that refunds will only be possible in the case of cancellations or rescheduling agreed upon by both parties. As long as Swiss Helicopter Wedding can provide any agreed-upon services, a refund will not be possible, as a unilateral cancellation by the Clients will result in one-sided costs. The costs incurred for services already rendered will be charged in full, regardless of when the cancellation by the Clients occurs. Refunds can and will only be applicable to services that have not yet been utilized.
5.1.5. Notice collaborations initiated within 60 days of the initial contact cannot be canceled with any refund possibilities.
5.1.6. Swiss Helicopter Wedding reserves the right to cancel the Agreement in cases of non-payment, breach of contract, or any other justifiable cause. In such cases, the cancellation and refund policies will apply, as agreed upon in writing.
5.1.7. Any cancellation or refund policies, whether by Swiss Helicopter Wedding or third parties contracted through Swiss Helicopter Wedding, will be communicated with the Clients when the Clients initially inquire about potential cancellations or refunds. Spontaneous cancellations, meaning cancellation inquiries by the Clients without any advance notice, will never result in any refunds.
6. Liability 6.1. Swiss Helicopter Wedding is committed to providing high-quality services. However, we shall not be held liable for any circumstances beyond our control, including but not limited to acts of nature, accidents, civil unrest, or vendor or venue-related issues.
6.2. Swiss Helicopter Wedding’s liability is limited to the terms outlined in the Agreement. The Clients are encouraged to discuss and establish liability and insurance requirements as part of the Agreement.
6.3. Swiss Helicopter Wedding’s total liability, if any, shall not exceed the total fees paid by the Clients for the services outlined in the Agreement.
7. Dispute Resolution 7.1. In the event of a dispute arising from this Agreement, both parties agree to engage in good faith negotiations to reach an amicable resolution.
7.2. If a resolution cannot be reached through negotiation, both parties agree to pursue mediation or arbitration in accordance with applicable local laws.
7.3. Any disputes, claims, or legal actions shall be governed by the laws of the jurisdiction in which Swiss Helicopter Wedding is registered.
8. Changes to the Terms and Conditions 8.1. Swiss Helicopter Wedding reserves the right to update these Terms and Conditions. Clients will be notified of any changes in writing. Continued use of our services constitutes acceptance of the updated Terms and Conditions.
